Overview Welcome to Oriental Spirit. This website is operated by Oriental Spirit. Throughout the site, the terms “we”, “us” and “our” refer to Oriental Spirit. We offer this website, including all information, tools, and services available from this site to you, the user, conditioned upon your acceptance of all terms, conditions, policies, and notices stated here. Oriental Spirit is powered by Shopify, which allows us to provide these Services to you.

By visiting our site and/ or purchasing something from us, you engage in our “Service” and agree to be bound by the following terms and conditions (“Terms of Service”, “Terms”), including those additional terms and conditions and policies referenced herein.

Section 1 - General Conditions & Account By agreeing to these Terms of Service, you represent that you are at least the age of majority in your state or province of residence. You may not use our products for any illegal or unauthorized purpose. We reserve the right to refuse service to anyone for any reason at any time. You are responsible for ensuring the security of your account credentials.

Section 2 - Oriental Spirit Products & Handcrafted Variations We take great pride in the authenticity of our products. However, please note:

  • Handcrafted Variations: Our Jian Shui Zitao teawares are 100% handcrafted by skilled artisans in Yunnan, China. Because they are not mass-produced, slight variations in color, size, carving details, and natural clay texture are normal and expected. These are the unique marks of authentic artisan craftsmanship, not defects.

  • Product Depictions: We have made every effort to display the colors and images of our products accurately. However, we cannot guarantee that your computer monitor's display will be completely accurate. The natural golden hue of our tea liquor or the subtle earthy gradients of our unglazed purple clay may vary slightly in person.

  • We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice.

Section 3 - Dual-Warehouse Shipping, Customs, and Duties Oriental Spirit operates a specialized dual-warehouse fulfillment system:

  • Teas & Gift Sets: Shipped exclusively within the United States from our US warehouse.

  • Teawares (Jian Shui Pottery): Shipped globally directly from our Mainland China artisan workshops.

For international shipments (Teawares), the customer is the importer of record and must comply with all laws and regulations of the destination country. The customer is fully responsible for any applicable customs duties, taxes, or import fees levied by the destination country. Oriental Spirit has no control over these charges. We are not responsible for delays caused by carriers, customs processing, or events beyond our control.

Section 4 - Orders, Pricing & Billing Prices for our products are subject to change without notice. We reserve the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household or per order. You agree to provide current, complete, and accurate purchase and account information for all purchases made at our store.

Section 5 - Intellectual Property Our Service, including but not limited to all trademarks, brands, text, images, graphics, videos, and their design and arrangement, are owned by Oriental Spirit and are protected by intellectual property laws. You may not reproduce, distribute, modify, create derivative works of, publicly display, or commercially exploit any material from our Service without our prior written consent.

Section 6 - Relationship with Shopify & Privacy Oriental Spirit is powered by Shopify. By using the Service, you acknowledge and agree that Shopify is not responsible for any aspect of the sales you make with us. Your submission of personal information through the store is governed by our Privacy Policy, and certain information is also subject to Shopify’s Privacy Policy.

Section 7 - Prohibited Uses You are prohibited from using the site or its content: (a) for any unlawful purpose; (b) to solicit others to perform or participate in any unlawful acts; (c) to infringe upon or violate our intellectual property rights or the intellectual property rights of others; (d) to submit false or misleading information; (e) to upload or transmit viruses or any other type of malicious code.

Section 8 - Disclaimer of Warranties; Limitation of Liability We do not guarantee, represent or warrant that your use of our service will be uninterrupted, timely, secure or error-free. You expressly agree that your use of, or inability to use, the service is at your sole risk. The service and all products delivered to you are provided 'as is' and 'as available' for your use, without any representation, warranties or conditions of any kind. In no case shall Oriental Spirit, our directors, officers, employees, affiliates, agents, or Shopify be liable for any injury, loss, claim, or any direct, indirect, incidental, punitive, special, or consequential damages of any kind arising from your use of any of the service or any products procured using the service.

Section 9 - Governing Law & Changes to Terms These Terms of Service shall be governed by and construed in accordance with the applicable laws. We reserve the right, at our sole discretion, to update, change or replace any part of these Terms of Service by posting updates and changes to our website. It is your responsibility to check our website periodically for changes.
